These general conditions regulate the tourist accommodation contract between the contracting person (hereinafter, also a user) and BARLEX, SL (hereinafter LES APIERES), tax number (“CIF”) B-65202038, registered office at c. St. Eduard, 19 -08172- Sant Cugat del Vallès- (Barcelona), registered in the Mercantile Registry of Barcelona, T. 41531, F. 49, H. B-387710, email info@apieres.com, telephone +34 600454539.
LES APIERES is duly registered in the Catalan Tourism Registry, with registration identifier PT-000349 PT-000354 PT-000355.

ACCEPTANCE OF THE GENERAL CONDITIONS

By contracting our services offered on this website, the contractor expressly states that he has read, understood and accepts without reservation these general conditions, as well as the particular ones that may be established. All general conditions will be permanently available to Users prior to contracting and may be stored and reproduced and printed in the current version at all times.
These conditions will have an indefinite period of validity, with LES APIERES reserving the right to modify them unilaterally, without this affecting the services or promotions that were contracted prior to the modification, for which it is recommended that users read them carefully each time they access this portal, understanding those that are published in it at any time in force.
The contract will not be archived. It will be written in Spanish, and in the consumer relations that take place in Catalonia, also in Catalan.

CONTRACTING PROCEDURE

• Step 1. Room selection. You must indicate the day of arrival and departure, number of people per room and click on “Search”. The available rooms will be shown below, and you must choose the one that interests you, the number of occupants, the number of rooms and the diet you prefer those offered.
• Step 2. Personal data. When continuing with the reservation, you must provide the personal information requested, including a credit card to guarantee the reservation. Once all the requested fields have been filled in, you must press the “confirm reservation” button to send the data entered.
• Step 3. Confirmation of the reservation. Received the data after clicking the button “confirm reservation”, received an email confirming the reservation.

TECHNICAL MEANS TO CORRECT ERRORS

During the reservation process and before pressing the button to proceed to confirm the reservation, the user will be able to correct any error and will be prevented from continuing if all the requested information is not provided. Also before proceeding to confirm the reservation, the user may change the content and even cancel it in its entirety, being able to go back to the previous screens to make the appropriate corrections.

CAPACITY OF THE ACCOMMODATION UNITS AND SPECIAL CONDITIONS OF USE OR ENJOYMENT OF THE ESTABLISHMENT

The maximum legal capacity of our accommodation units as well as the special conditions and conditions of use or enjoyment of the establishment are those indicated in each case on the web before making a reservation.
It is necessary that they contact the establishment in advance to confirm the admission of pets.
During their stay at the establishment, minors must be accompanied by an adult.

WHO CAN CONTRACT

In order to contract the tourist accommodation services offered on our website, the user declares that they are at least 18 years old.

CANCELATION CONDITIONS

Cancellations of reservations made 15 days before the arrival date will not entail penalties, returning the amounts that have been paid, unless the client prefers to apply them for a future reservation.
Cancellations of reservations made before 72 hours of the arrival date will entail a penalty of 50% of the total amount of the stay.
Cancellations of reservations made during the 72 hours prior to the arrival date or in case of no-show on the scheduled day of arrival, will entail a penalty of 100% of the total amount of the stay.

COMPENSATION FOR WAIVER OF STAY

If the reserved unit is abandoned before the date until which it was reserved, unless expressly agreed by the parties, the equivalent of 100% of the price of the day of departure will be charged.

PRICES AND OTHER EXPENSES

The prices applicable to each accommodation are those published on the website and applied automatically to which, where appropriate, additional expenses or services that the client has consented will be added, configuring the sum of all these concepts the total due of payment in the last phase of it.
The prices indicated include the Value Added Tax (VAT), expressed in the Euro currency (€).
The tax on stays in tourist establishments (IEET) is applicable to people who stay in tourist accommodation establishments in Catalonia over 16 years of age, accruing at the beginning of the stay. Its payment will be required on the day of departure depending on the age of each person staying.

GUARANTEE, PAYMENT METHODS AND CONFIRMATION OF THE RESERVATION

To guarantee and formalize the reservation, you must pay as a down payment, 20% of the total price of the stay and in the case of renting the entire establishment you must also pay 30% of the total stay as Deposit, which will be returned at the end of the stay and once it has been verified that there have been no damages or flaws.
Payment is made through a secure gateway, in which the bank issuing the card will be in charge of verifying the identity of the cardholder and its authenticity before authorizing the payment, as well as the protection of the data of the client. In this way, we also at no time have your financial data, which provides greater security to the payment process.
Any incident that may arise will be the responsibility of the issuer, and the client must contact the bank in question.
When we receive your reservation request and once the payment and deposit have been satisfied and, if applicable, the deposit, we will proceed to confirm it by email at the address you have provided, within 24 hours, sending you an acknowledgment of receipt that will indicate the reservation number and will contain the general and, where appropriate, particular conditions of the contract.
The rest of the payment of the reservation will be made directly at the establishment, preferably by credit card, unless there is a penalty for having cancelled the reservation outside of the established deadlines, or does not show up at the establishment on the agreed date input. In these cases, the corresponding amount will be charged to the card.

BILLING OF THE RESERVATION

The client authorizes that once the payment is made, if he wants an invoice, he is issued an electronic invoice, being able to revoke the consent at any time.

COMMUNICATION WITH THE USER

Communications with the user of the tourist accommodation establishment will be made through electronic means, such as email, telephone, including instant messaging, so you must provide the active data at all times for this purpose.

RIGHT OF WITHDRAWAL

In accordance with current regulations, you do not have the right to withdraw from this contract for the supply of accommodation services for purposes other than serving as housing.

INFORMATION ABOUT THE RESERVATION, COMPLAINTS AND CLAIMS

APPLICABLE LAW AND JURISDICTION

The interpretation and application of these conditions will be governed by Spanish law.
In case of conflict, without prejudice to submitting to what is imperatively established by law, especially when the contracting party is a consumer or user, waiving any other forum that may correspond to them, the parties expressly submit to the jurisdiction of the city courts of Rubí.
